Subject: Information notice pursuant to Art. 13 of EU Regulation 2016/679 - European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation)

The regulation in question governs the protection of personal data and imposes a number of obligations on those who process this data. One of these obligations is to inform the person to whom the data relates.

Given the above, we inform you that the website you are browsing (hereinafter referred to as the “Site”) is owned and managed by Zucchetti Centro Sistemi SpA, with registered office in Via Lungarno n. 305, Terranuova Bracciolini (AR).

Since the navigation on the Site by users involves the processing of personal data, we hereby provide you with information on the data referrable to you that will be collected, the purposes and methods of processing and, in general, everything else provided in your interest by article 13 et seq. of EU Regulation 2016/679 (GDPR), which entered into force on 25 May 2018 (hereinafter referred to as the “Regulation”) and therefore,

we inform you that:

1. Identity and contact details of the Data Controller

Pursuant to the Regulation, the Data Controller (hereinafter referred to as the “Controller”) is the entity that, individually or jointly with others, determines the purposes and methods of the processing. 2. Purpose of the processing of personal data and legal basis of the processing

The personal data communicated or that will be requested from you are necessary for the following purposes:

General purposes

a) to enable you to navigate through the various sections of the site and optimise your interactions with it;
b) to answer technical or commercial support questions sent by you and to keep a database of frequently asked questions, proposals and communications;
c) to collect your contact details, provided through the appropriate form, in order to contact you again;
d) to manage other aspects of navigations (see also the “cookie policy” section);
e) to select, assess and search for personnel for your organisation;
f) to support the commercial and administrative management in relations with customers;
g) to fulfil any legal requirements and obligations;
h) non-automated qualification of customers;
 

The legal basis justifying the processing is determined by the laws in force and in particular by article 6 of the Regulation. We would like to inform you that, where it is an indispensable prerequisite for processing (art. 6, para. 1, lett. a), consent to the processing of personal data for such purposes is not compulsory, but failure to provide it may prevent you from accessing the services offered by the Site.

Direct marketing purposes

Marketing activities through the sending of promotional and advertising materials relating to products or services, by post, email, telephone, fax, text message, newsletter and the like. We also inform you that, should you no longer wish to receive such communications, you can make an express request through the contacts referred to in this notice.  In particular, we would like to point out that the newsletters and emails you receive will contain a specific link for sending a direct request to be excluded from the relative mailing list;

The legal basis justifying the processing is determined by the laws in force. In particular, we inform you that your personal data may be processed for the above purposes only after you have given your free, optional and always revocable consent, except in the case set forth in article 130, paragraph  4 of Leg. Decree no. 196 of 30 June 2003.

Profiling for marketing purposes

For profiling purposes, i.e. to analyse, also by automated means, your preferences and interests and to offer services, contents, initiatives and promotions personalised for you (by ordinary mail, telephone calls, email notifications on applications and newsletters); after having voluntarily given your consent, you will nevertheless have the right to object, at any time and without charge, to the processing of your data for this purpose by using the contact information specified in this information notice.

3. Nature of Personal Data

Your personal data will be used for the purposes indicated in chapter 3. The personal data collected essentially relate to:

a) data identifying natural persons (personal details, contact details, bank details, etc.);
b) Navigation data received as a result of your interactions with the Web-App (technical cookies), such as user recognition, language and session saving. This information is not collected to be associated with you, but by its very nature could, through processing and association with data held by third parties, make it possible to identify the person to whom it refers. This category includes such data as time and date of access, the type, IP address and location of the devices used by you to access the Site, the queries made to the Web-App, the responses delivered by the Web-App during the use of the Web-App. Please refer to the relative cookie policy. Please note that if you consent to the use of cookies, your data will also be processed by third parties in accordance with the aforementioned cookie policy and the  respective privacy policy.

4. Recipients or categories of recipients of personal data

The data in question will not be “disseminated”, i.e. it will not be made known to unspecified persons, unless you give your express permission. However, solely for organisational reasons, the data will be brought to the attention of the entities designated as data processors, i.e. employees of the Data Controller, as well as third parties such as collaborators and suppliers of the Data Controller (e.g. providers of technical and technological services, hosting services, support and maintenance services, etc. as well as credit and banking institutions) for services connected to the Site and partners of the Data Controller (e.g. distributors, resellers, etc.), who will be appointed as Data Processors pursuant to article 28 of the Regulation.

5. Transfer of personal data to a third country or an international organisation

Your data will be processed mainly in Italy and in any case, in countries belonging to the European Union. However, in order to be able to pursue the processing purposes explained above, it may be necessary to transfer your data to non-EU countries. Any transfer of your data to countries will take place in compliance with the requirements of articles 44 et seq. of the Regulation.

6. Period of retention of personal data/criteria used to determine this period

The processing will be kept for the time strictly necessary to achieve the purposes for which the data was collected, until the possible revocation of consent or within the maximum terms permitted by law where the continuation of processing is necessary to meet legal requirements or to fulfil orders issued by public authorities and/or supervisory bodies.  After the term, the data will be destroyed or made anonymous. 

7. Exercisable rights

It should be noted that, in addition to being able to lodge a complaint with the Supervisory Authority, you may exercise a number of rights provided for by the regulation in force, which are summarised as follows: art. 15 - right of access of the data subject; art. 16 - right to rectification; art. 17 - right to erasure (“right to be forgotten”); art. 18 - right to restriction of processing; art. 20 - right to data portability; art. 21 - right to object; art. 22 - right not to be subject to a decision based solely on automated processing, including profiling.

8. Non-compulsory nature of provision

The provision of personal data is not compulsory by law. However, as you can easily understand, the provision of your personal data is essential in order to carry out the processing operations described in chapter 3 and, therefore, refusal to provide your personal data may make it impossible to provide the services on this Site.

9. Copyright

The Site is owned and managed by Zucchetti Centro Sistemi SpA; the graphics, images and text on the Site are subject to copyright with all rights reserved. Since the internet Site is a “work of intellect of a creative nature…” it is subject to copyright (art. 2575 of the Italian civil code) and as such belongs to the author or to whoever purchased the rights. In any case, it is permitted to download or print single pages or sections of the Site provided that the copyright or other notes concerning the reserved property are not removed. Downloading or copying of the Site will not involve the transfer of any ownership rights on any software or material. Publication, reproduction (in whole or in part), transmission (by electronic means or otherwise), modification and hypertext linking of said documents on other sites for advertising or commercial purposes is prohibited without the prior written consent of Zucchetti Centro Sistemi SpA. The violation of these regulations are punishable by penalties, including criminal penalties.

10. Waiver of responsibility

Zucchetti Centro Sistemi SpA does not assume any legal responsibility regarding the accuracy, completeness or usability of any information, apparatus, product or process declared on the Site, or other material which can be accessed through it, since such information is subject to continuous changes following the constant technological development of the company’s products and services. Zucchetti Centro Sistemi SpA shall therefore not be liable for any special, incidental, indirect or consequential damages, or any damages whatsoever resulting from any use of the Site, or any sites linked to it, nor shall it be liable for damages of any kind arising from your reliance on information contained in the Site, since this information is purely for illustrative purposes.
